Morrison & Foerster provides comprehensive representation involving a broad range of insurance and insurance-related issues.  The firm has represented and counseled clients with respect to insurance matters involving bad faith litigation; “vanishing premium” claims; class action lawsuits; unfair competition clauses; construction defect claims; directors and officers liability; environmental liability; “force-placed” insurance issues; professional liability; and toxic torts. Among the firm’s insurance industry clients are Fireman’s Fund, GEICO, The Hartford, John Hancock, Occidental Life Insurance, Traveler’s and Transamerica.

The firm has extensive experience addressing and litigating insurance coverage issues under general liability insurance policies relating to claims for clean up and remediation costs at Superfund and other environmental pollution sites and to claims for bodily injury or property damage allegedly caused by exposure to asbestos, silica or other chemicals. In addition, the firm has been active in defending clients against claims of breach of the covenant of good faith and fair dealing and related statutory claims. The firm has both pursued and defended bad faith claims based on the law of various jurisdictions in cases brought in both state and federal court. The firm has also represented insurance companies in connection with complaint proceedings involving claims handling procedures and other matters before administrative agencies, including the California Department of Insurance and the New York Insurance Department.

The firm has extensive experience with directors and officers insurance coverage issues. As well as advising clients in these areas, members of the firm have also lectured on directors’ and officers’ insurance issues, and have published several articles and outlines on directors’ and officers’ insurance coverage for seminars and continuing legal education courses.
